Beilharz v. Florida Paints: AWW Increase and Temporary Benefits Denied
In Beilharz v. Florida Paints and Coatings, LLC/AmTrust North America, Inc. and Technology Insurance Company Inc., OJCC Case No. 26-000035JAW, Judge Jack A. Weiss considered average weekly wage and temporary indemnity claims following a June 18, 2020 lumbar spine injury.
The JCC found the claimant reached overall MMI as of June 6, 2025. The order rejected reliance on stale opinions from a deauthorized neurosurgeon and credited evidence that post-June 2025 pain-management care was palliative medication management rather than treatment reasonably expected to produce further recovery or lasting improvement.
The JCC denied additional temporary indemnity benefits after June 6, 2025, denied reclassification of prior TPD payments as TTD, and rejected a further AWW increase beyond the employer/carrier's $1,096.15 calculation for a one-time $500 COVID bonus. Fees and costs were denied on the claimant's unsuccessful claims, while jurisdiction was reserved over the stipulated fee/cost entitlement tied to the earlier AWW increase and over prevailing-party costs.
