DeStefano v. Superior Auto Body: TPD Benefits Awarded After Kidney Surgery Delay

JCC awarded Kenneth DeStefano temporary partial disability benefits for the unpaid gap from November 17, 2025, through January 5, 2026, after finding his compensable right-hip injury continued to require light-duty restrictions.

The order credited Dr. Nienke's clarification that DeStefano should have remained on light duty even though kidney-cancer surgery interrupted physical therapy, and it granted penalties, interest, costs, and attorney's fees while reserving jurisdiction over the fee and cost amounts.
