In Fletcher v. Air Gas USA, LLC / Starr Indemnity & Liability Company, OJCC Case No. 25-015045MAM, Judge Mark A. Massey considered whether the claimant proved that a testicular torsion injury arose out of his forklift work.

The JCC accepted the employer/carrier's urology IME over the claimant's expert, finding no striking, pinching, or other scrotal trauma at work. The order also found the symptom timeline more consistent with spontaneous torsion related to a congenital bell-clapper deformity than with trauma-induced torsion.

Because the claimant did not prove a causal relationship between the employment and the injury by medical evidence and reasonable medical certainty, the JCC denied and dismissed the petitions for benefits with prejudice.
