JCC Finds Back Compensable but Denies Further Care Without Medical-Necessity Proof
In OJCC Case No. 26-008197NAC, Chasity Ibarra injured her back and right knee while freeing a lawn mower stuck in rocks during her work for Lake County Parks and Trails. The employer/carrier had accepted the back and right knee as compensable, but later stopped back treatment after a one-time-change orthopedic physician attributed her symptoms to pre-existing degeneration.
The JCC rejected that physician’s opinions as lacking credibility and found the employer/carrier failed to prove a break in the causal chain. The order therefore granted the claim that the back was compensable; the right-knee compensability claim was denied as moot because treatment remained authorized.
Even so, the claimant presented no accepted medical opinion establishing that continued orthopedic or pain-management care was medically necessary. The JCC denied authorization of those providers within a reasonable distance of her home and reserved jurisdiction over attorney’s fees and costs.
