JCC Denies PTD After Finding Claimant Could Perform Sedentary Work
In Loaisiga v. SS Carpenter & Remodeling, Inc., the claimant sought permanent total disability and supplemental benefits beginning December 2, 2025. The parties stipulated that he reached overall maximum medical improvement on December 1, 2025.
The JCC found that the claimant's permanent restrictions did not prevent sedentary employment. The order also found that his limited, largely undocumented job search was not adequate and accepted the employer/carrier's vocational expert over the claimant's expert.
Because the claimant did not prove that his physical limitations prevented at least sedentary employment within 50 miles of his residence, the JCC denied and dismissed the claims for PTD and supplemental benefits, penalties, and interest. Employer/carrier-paid attorney's fees and reimbursement of costs were also denied.
