In Lumzy v. Cytiva US LLC/Sedgwick CMS, OJCC Case No. 24-004320JW, the claimant sought temporary partial disability benefits beginning June 18, 2024, an updated left-shoulder MRI, and related penalties, interest, costs, and attorney’s fees. She also filed a later petition seeking left-shoulder surgery.

Judge Jonathan E. Walker accepted the authorized orthopedist’s opinions over the claimant’s independent medical examiner. The judge found that the 2022 accident caused only a temporary exacerbation of a preexisting shoulder condition, was no longer the major contributing cause of the claimant’s disability or need for treatment, and that the claimant had reached maximum medical improvement without work-related restrictions on June 18, 2024.

The JCC denied and dismissed with prejudice the claims for temporary partial disability benefits, the updated MRI, surgery, and related penalties, interest, costs, and attorney’s fees. The order also cancelled all pending litigation events.
