JCC Denies Compensability for Alleged Repetitive Trauma

In Oakley v. Gerber Collision - Glass / Charter Oak Fire Insurance Co. and Travelers Insurance, OJCC Case No. 25-020551JEJ, Judge Jill E. Jacobs addressed whether bilateral carpal tunnel and cubital tunnel conditions were compensable as repetitive trauma.

The employer/carrier defended based on late reporting and lack of objective medical evidence establishing major contributing cause. After weighing the testimony and the records offered for fact purposes, the JCC found the claimant did not carry his burden to prove an injury by accident arising out of and in the course and scope of employment.

Compensability was denied with prejudice, and the related claim for attorney's fees and costs was also denied.
