Perez v. Elijah Roofing: TTD, TPD, and Medical Care Awarded
In Jairo Mazariegos Perez v. Elijah Roofing & Construction LLC, OJCC Case No. 25-016056JW, Judge Jonathan E. Walker considered claims arising from a February 1, 2025 accident. The claimant testified that he fell from a roof while working for the employer, fractured his left forearm, underwent surgery, and had not returned to work. The employer did not participate in the final hearing, and its defenses had been stricken.
The JCC accepted the claimant’s uncontroverted testimony and supporting medical and payment records, finding the work accident compensable. The order found that the claimant was completely off work through April 1, 2025, then remained subject to work restrictions without reaching maximum medical improvement. It awarded temporary total disability benefits from February 1 through April 1, 2025, and temporary partial disability benefits from April 2, 2025, and continuing.
The JCC also authorized a treating physician and medical care for the work injuries and required the employer to reimburse treatment provided by Hughston Clinic. The order granted compensability, penalties, interest, costs, and attorney’s fees, reserving jurisdiction if the parties could not agree on the amounts.
