JCC Denies Compensability After Finding No Labor Day Work Accident
In Mario Sanchez v. HH Construction Group, Inc. and Bridgefield Casualty Insurance Company, OJCC Case No. 26-004925SMS, the Miami JCC considered claims for compensability, treatment by Dr. Luis Ramirez, and authorization of a primary care physician after an alleged September 1, 2025 accident.
Sanchez testified that he injured his left arm and hand while removing wood at a construction site on Labor Day. The employer's comptroller testified that HH Construction was closed that day, no employees were scheduled to work, and the submitted time records showed zero hours for every employee, including Sanchez.
The JCC credited the comptroller's testimony and found that Sanchez did not prove an accident arising out of and in the course of employment. The judge also found that he presented no admissible medical evidence establishing that the alleged accident was the major contributing cause of his left hand and arm conditions.
The order denied compensability, treatment by Dr. Ramirez, authorization of a primary care physician, attorney fees, and costs. It also dismissed the February 27, 2026 Petition for Benefits.
