JCC Denies Temporary Disability Benefits Absent Medical Support
In Teklinsky v. David R Vangorp Inc d/b/a Strait Plumbing / Federated Mutual Insurance, OJCC Case No. 25-006439RJH, Judge Ralph J. Humphries addressed a pro se claimant's request for temporary disability benefits, an average weekly wage adjustment, and additional penalties and interest.
The JCC denied temporary total disability because there was no medical evidence placing the claimant in a no-work status. The JCC also denied additional temporary partial disability benefits for the period from the accident date (February 21, 2025) through November 12, 2025, finding the record lacked medical evidence establishing work restrictions before November 12.
On the wage issue, the JCC found the employer/carrier's calculation was correct and held no adjustment was due. With no benefits awarded, the claims for additional penalties and interest were denied.
