In Turner v. Foundation Building Materials, LLC, OJCC Case No. 25-019538EBG, the claimant sought a spinal cord stimulator and temporary partial disability benefits after a July 2025 rear-end collision aggravated pre-existing lumbar degeneration.

Judge Erik B. Grindal credited the claimant and his independent medical examiner, finding the accident was the major contributing cause of the lumbar symptoms and need for treatment. The order also found the employer/carrier had accepted compensability through its pretrial stipulation and by providing treatment for more than 120 days without timely denying the lumbar conditions.

The JCC granted the spinal cord stimulator and TPD from January 20, 2026, forward, with penalties and interest. A separate claim for psychological clearance was denied because no medical provider had recommended it, while attorney fees and costs were awarded with jurisdiction reserved as to amount.
